Site Access

Indie Jhola grants you a limited permission to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it. This permission does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Indie Jhola. If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Indie Jhola reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

You grant Indie Jhola the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Indie Jhola for all claims resulting from content you supply. Indie Jhola has the right but not the obligation to monitor and edit or remove any activity or content. Risk Of Loss

All items purchased from Indie Jhola are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Product Descriptions

Indie Jhola attempts to be as accurate as possible. However, Indie Jhola does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Indie Jhola itself is not as described, your sole remedy is to return it in unused condition.

Pricing

Except where noted otherwise, the List Price displayed for products on our website, in Indian Rupees represents the full price of the product, unless specified otherwise in the Shipping Fees.

With respect to items sold on Indie Jhola, we charge your credit card before your order has entered the shipping process. For any reason if we are not able to ship you products as per your order, we will intimate you electronically and refund the value of the products not available. Any additional Shipping Fees, if applicable, will not be refunded.

Despite our best efforts, a small number of the items in our catalogue may be mispriced. If we discover a mispricing, we will do one of the following:

• If an item’s correct price is lower than our stated price, we will charge the lower amount and ship you the item.
• If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Please note that this policy applies only to products sold and shipped by Indie Jhola.

The prices displayed on the site are quoted in Indian Rupees.

Shipping

All of Indie Jhola orders are shipped door-to-door from our warehouse in Jaipur, India to your provided shipping address via our logistic partners. Processing the order normally takes 24-48 business hours and then Shipping normally takes 2-9 business days.

Shipping destinations offered by Indie Jhola for delivery will be extended and updated from time to time and listed online.

We do not ship backorders. We aim to keep every item on our website in stock. If there is an item which you purchase and then we realize this item is not available, we will promptly inform you within 1-2 working days of your purchase and fully refund your money for the out of stock item.

We can only process one shipping address per order. So, if you would like to order several items and ship to different people, please treat these as separate orders. We cannot ship to Post Office Box addresses and take no responsibility for non-delivery of orders in case the delivery address includes P. O. Box details in any part or form.

Our logistics partners will attempt delivery 3 times at the delivery address specified by you in the order, before they contact us that your package is not deliverable.

Cancellation, Returns and Refunds

Indie Jhola will accept return and exchange the product if you are not satisfied with your purchase for any reason. Exchanges or returns must be made within 10 days of receiving your order. for more details, please review our Cancellation, Returns and Refunds Policy. Do read all sections carefully to understand the conditions and cases under which return, refund & exchange will be accepted and check the Products display page for Product specific return information.

Sizing

The fit of our clothing depends on the cut, fabric and style of each garment. Some garments are designed to have a looser, relaxed fit and some garments are styled to be more fitted. Please review our sizing guide to select the size best suited to you.

Product Properties And Wash Care

Some of Indie Jhola’s products are handcrafted and handmade. The subtle variations in colour, texture and finish are intrinsic to hand made products.

Colours: We have done our best to display as accurately as possible the colours of the products shown on this Website. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be accurate.

Disclaimer Of Warranties And Limitation Of Liability

This site is provided by Indie Jhola on an “as is” and “as available” basis. Indie Jhola makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, Indie Jhola disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Indie Jhola does not warrant that this site, its servers, or e-mail sent from Indie Jhola are free of viruses or other harmful components. Indie Jhola will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Whilst we try and ensure that the details, descriptions and prices of the products displayed on the Website are accurate, errors may occur. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any order that you may place based on such erroneous, inaccurate or out-of-date information regarding pricing, shipping, payment terms, or return policies.

To the maximum extent permitted by applicable law, Indie Jhola assumes no liability or responsibility for (i) any errors, mistakes, or inaccuracies of content displayed on the Website; (ii) any personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Website or any product; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (iv) any interruption or cessation of transmission to or from the website; and/or (v) any bugs, viruses or the like that may be transmitted to or through our Website by any third party.

Indemnification

You agree to defend, indemnify and hold Indie Jhola harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the site.

Applicable Law

By visiting Indie Jhola, you agree that the laws of India, under the jurisdiction of the Rajasthan High Court, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Indie Jhola.

Disputes

Any dispute relating in any way to your visit to Indie Jhola or to products you purchase through Indie Jhola shall be submitted to confidential arbitration in Jaipur, Rajasthan, only, except that, to the extent you have in any manner violated or threatened to violate Indie Jhola’s intellectual property rights, Indie Jhola may seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
